GENERAL TERMS AND CONDITIONS

1. Promotion is open to residents of the United Kingdom who are aged 18 or over, except employees of the Promoter (BrewDog PLC) and REL Field Marketing, or their immediate family members or anyone professionally associated with this promotion.

2. Purchase and internet access are required. Winners must retain their wining can until verified as a winner and prize is confirmed.

3. Promotion Period: 00:01 on 1 April 2023 until 23:59 on 30 August 2023.

4. Prizes are not transferrable and cannot be exchanged for cash. In the event of unforeseen circumstances, the Promoter reserves the right to substitute a prize, or part of a prize, for an alternative of equal or greater value.

5. It is the responsibility of the claimant to provide correct, up-to-date details when entering the promotion and on acceptance of their prize. The Promoter cannot be held responsible for winners failing to supply accurate information which affects prize acceptance or delivery of their prize.

7. A winner may be requested to participate in publicity arising from the promotion, though for regulatory reasons if a winner is or looks under 25 such publicity will not include photographs of the winners.

8. Fulfilment or any element of this promotion is delayed or affected due to the continuing Covid-19 pandemic and resulting Government restrictions, any affected entrants will be contacted by the Promoter and kept updated of any unavoidable changes to the promotion or prizes.

9. Privacy:The details you provide when entering this promotion, namely your email address, will be held by the Promoter under the terms of its privacy policy, available here: https://www.brewdog.com/uk/cookie-and-privacy-policy. Your personal data will be used by the Promoter and its agents acting on their behalf only for the operation of this promotion. The Promoter is bound by the UK Data Protection Act 2018 and all applicable laws. Your personal data will be stored for 3 months from the end of the Promotion Period, after which it will be deleted. Your personal data will not be used to marketing purposes. You can request access to your personal data, or have any inaccuracies rectified, by sending an email to [email protected] with “personal data” in the subject line. By participating in the Promotion, you agree to the use of your personal data as described here.

10. The surname and county of residence of the winning cans will be available by sending an email to [email protected] with “Gold Can Winners” in the subject header to arrive between 1 July and 30 September 2023. Winners can object to disclosure, or request that disclosure be limited in scope when confirming their win. In any case, if a regulatory body requests confirmation of the existence of winners, or evidence of receipt of prizes, the Promoter shall be entitled to disclose the information of any winner to the regulatory body only.

11. Claim Process: All claims must be made by 23:59 on 30 August 2023. Claimants will be contacted within 5 working days by the Promoter to confirm claimant as a winner, to ask for additional verification as set out in this clause, or to reject the claim for non-compliance. The Promoter reserves the right to verify each claim including but not limited to asking for the claimant to send the winning can to the Promoter or its agent, to confirm proof of residency or age (photographic identification). The Promoter reserves the right to refuse to award a prize or withdraw prize entitlement and/or refuse further participation in the promotion and disqualify the participant where the Promoter has reasonable grounds to believe that a claimant has breached these Terms and Conditions or the spirit of the promotion, any instructions forming part of this promotion’s entry requirements.

12. Participants in this promotion agree that neither the Promoter nor any of the promotional parties will have liability for: a. any faulty or failed electronic data transmissions; b. any communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers, human error or providers utilised in any aspect of this Promotion; c. any inaccessibility or unavailability of the internet or email services; d. any damage to prizes sent to participants; e. any non-delivery of prizes caused by the provision of wrong information by participants, postal disputes or other causes beyond the Promoter’s control; or f. any system failures on the email services.

13. Insofar as permitted by law, the Promoter, its agents, and distributors will not in any circumstances be responsible or liable to compensate the winners or accept any liability for any loss, damage, personal injury or death occurring as a result of entering or taking up the Prize. Nothing in this clause shall limit the Promoter’s liability in respect of; (a) death or personal injury arising out of its own negligence; or (b) liability arising out of the Promoter’s fraud.

14. Entries (bulk or otherwise) made from trade, consumer groups or third parties will not be accepted. If it becomes apparent that a participant is using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’, masking their identity by manipulating IP addresses, using identities other than their own or any other automated means in order to increase that participant’s entries into the draw in a way that is not consistent with the spirit of the promotion, that person’s entries will be disqualified and any prize award will be void.

15. Incomplete, illegal, misdirected or invalid entries, or entries not in accordance with these Terms and Conditions will not be accepted. Proof of sending will not be accepted as proof of delivery. The Promoter takes no responsibility for entries delayed, incomplete or lost due to technical reasons or otherwise.

16. If for any reason the Promotion is not capable of running as planned for reasons beyond the control of the Promoter (including but not limited to tampering, unauthorised intervention, fraud, technical failures) which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion), the Promoter reserves the right (subject to any written directions given under applicable law) to disqualify any individual who tampers with the running of the Promotion or to cancel, amend, terminate or temporarily suspend this promotion, with no liability to entrants or third parties.

17. The Promoter has no control over internet or communication networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter will not be held liable to any individual for any fraud committed by any third party nor for any event beyond its control including, but not limited to, user error and any network, computer, hardware or software failures of any kind which may restrict, delay or prevent a participant’s entry to the promotion.

18. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.

19. The Promoter’s decision is final with regard to all promotional matters and no correspondence will be entered into.

20. These terms and conditions are governed by the laws of England and Wales and shall be subject to the exclusive jurisdiction of the English and Welsh courts unless you live in another part of the United Kingdom, in which case your local courts will have jurisdiction.

PROMOTIONAL PACKS SPECIFIC TERMS AND CONDITIONS

21. To participate: Find a winning can in a promotional pack of BrewDog (see clause 23 below for promotional pack ranges) during the Promotion Period. Winning cans are cans that have a message written on the can stating that the can represents a Gold Plated Can, together with a unique code and details on how to claim. To claim the Prize, you must email [email protected] before the end of the Promotion Period and include in your email (1) the 6-digit unique code, (2) an image of the code on the winning can, (3) your name, (4) your email address, (5) your postal address within the United Kingdom, and (6) your date of birth. The Promoter agent will verify your claim and process your prize. Do not dispose of the winning can until your prize claim has been verified.

22. Prizes: There are 10 winning cans. Each winning can entitles the owner to £5,000 cash and a gold plated can. Maximum one claim per winning can.

24. Prize allocation (Promotional Packs): The 10 winning cans will be randomly seeded into the Promotional Packs (see clause 6) by an independent agency, REL Field Marketing, which has been retained by BrewDog for the sole purpose of distributing the winning cans.

25. PERFECT DRAFT SPECIFIC TERMS & CONDITIONS

To participate via Perfect Draft: Purchase a BrewDog Lost Lager keg between 00.01 19/04/2023 and 11.59 20/05/2023 for the chance to win.  UK 18+ purchase or promotional keg required. Internet access, email address required. RETAIN WINNING KEG.  Find a keg with a winning message together with a unique code. 5 x winning kegs: one keg entitles claimant to £1,000 plus 1 x Gold Plated Pint Glass, the other 4 kegs entitle claimants to £1,000. 26. To participate via brewdog.com/uk: Place an order on brewdog.com/uk between 24/04/2023 and 15/05/2023 (or while stocks last) and receive a scratchcard with a guaranteed prize. All scratchcards will win a prize, but only one scratchcard will win the top prize of a gold-plated pint glass and £5,000 cash. Subject to availability. 

27. To participate via BrewDog bars: Spend a minimum of £10 at any participating BrewDog bar between 26/04/2023 and 17/05/2023 (or while stocks last) to receive a scratchcard with a guaranteed prize. All scratchcards will win a prize, but only one scratchcard will win the top prize of a gold-plated pint glass and £5,000 cash. Subject to availability.
